Agreement to Terms

By accessing or using Puff Pause Pass ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting notice in the app or updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Description of Service

Puff Pause Pass is a cannabis moderation app that provides:

  • Personal journaling tools for tracking cannabis use
  • AI-powered analysis and personalized feedback
  • Progress tracking including streaks and statistics
  • Community features including chat rooms, forums, and direct messaging
  • Educational content about harm reduction and moderation strategies

The Service is not a medical service. Puff Pause Pass does not provide medical advice, diagnosis, or treatment. The AI feedback is for informational and motivational purposes only and should not be considered professional medical or therapeutic advice.

Eligibility

To use Puff Pause Pass, you must:

  • Be at least 21 years old in jurisdictions where the legal cannabis age is 21, or at least 18 years old in jurisdictions where the legal cannabis age is 18
  • Have the legal capacity to enter into these Terms
  • Not be prohibited from using the Service under applicable laws

By using the Service, you represent and warrant that you meet these eligibility requirements.

Account Registration

To access certain features, you may need to create an account. When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You may also use the Service in "guest mode" without creating an account. Guest mode data may be lost if you clear your browser data.

Acceptable Use

When using Puff Pause Pass, you agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Harass, bully, threaten, or intimidate other users
  • Post content that is hateful, discriminatory, violent, or sexually explicit
  • Share personal information about others without their consent
  • Impersonate others or misrepresent your affiliation with any person or entity
  • Attempt to access accounts or data that don't belong to you
  • Interfere with the proper functioning of the Service
  • Use automated tools to access the Service without our permission
  • Sell, resell, or commercially exploit the Service
  • Encourage or promote illegal drug use or sales

Community Guidelines

Our community features are built on mutual respect and support. When participating in chat rooms, forums, or direct messages:

  • Be supportive: This is a judgment-free space. Respect each person's journey.
  • Protect privacy: Don't share others' personal information or stories outside the community.
  • Stay on topic: Keep discussions relevant to cannabis moderation and personal wellness.
  • No sourcing: Do not ask for or share information about purchasing cannabis or other substances.
  • Report concerns: If you see content that violates these guidelines, report it to our team.

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines, at our sole discretion.

User Content

You retain ownership of content you create ("User Content"), including journal entries, forum posts, and chat messages. By posting User Content, you grant us a license to:

  • Store, process, and display your content as necessary to provide the Service
  • Process your journal entries through our AI systems to provide personalized feedback
  • Display your public community content (posts, chat messages) to other users

Your private journal entries are not shared with other users. Only content you explicitly post to community features is visible to others.

You represent that you have the right to share any content you post and that it does not violate any third party's rights.

Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Puff Pause Pass and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or branding without authorization
  • Reverse engineer or decompile any part of the Service
  • Remove or alter any proprietary notices

Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of AI-generated feedback
  • Uninterrupted or error-free operation
  • Security of your data (though we implement reasonable measures)

Not Medical Advice: The Service is for informational purposes only. AI feedback and suggestions are not medical advice. If you are struggling with substance use, mental health issues, or any health concerns, please consult a qualified healthcare professional.

Legal Compliance: You are responsible for ensuring your use of cannabis complies with all applicable laws in your jurisdiction. Puff Pause Pass does not encourage or condone illegal activity.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUFF PAUSE PASS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or content
  • Loss of profits or revenue
  • Personal injury or emotional distress
  • Any damages arising from your use of or inability to use the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Puff Pause Pass and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Any content you submit to the Service

Termination

You may stop using the Service at any time. You can delete your account from the Settings page.

We may suspend or terminate your access to the Service at any time, with or without cause, including for:

  • Violation of these Terms
  • Conduct that we believe is harmful to other users or the Service
  • Extended periods of inactivity
  • Discontinuation of the Service

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that should survive termination will remain in effect.

Dispute Resolution

Informal Resolution: Before filing a formal dispute, you agree to contact us through the app to attempt to resolve the issue informally.

Governing Law: These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.

Jurisdiction: You agree to submit to the personal jurisdiction of the state and federal courts located in Kent County, Michigan for any disputes arising from these Terms or the Service.

General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Puff Pause Pass.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
  • No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.
